Conditions of Sale

BREAKFAST AWAY LDA.

These general conditions of sale are agreed between Breakfast Away LDA which is a private limited company, with share capital of € 1,000 with registered office at Rua Dr. Arnaldo da Assunção Matos, n.º 4, 2.º Esquerdo District: Faro Municipality: Olhão Parish: Quelfes 8700 583 Olhão, registered at the Commercial Registry Office of Lisbon, NIF 515079340 hereinafter referred to as “Breakfast Away – Breakfast Hotel at Home” and persons wishing to purchase through the website www.breakfastaway.pt hereinafter referred to as “User”. The Breakfast Away brand is a registered trademark owned by Breakfast Away LDA. The parties agree that purchases made through this website will be governed exclusively by this contract to the exclusion of any conditions previously available on the Website.

OBJECT

The purpose of these general conditions of sale is to provide and define all the necessary information to the user on the ordering, sale, payment and delivery of purchases made on the website www.breakfastaway.pt. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order between the Contracting Parties.

ORDERING

1. The User may submit his/her order through the purchase process referred to on the above website as “confirm”, after having used the online device by selecting “Add to cart”:

2. To send your order, you must:

Register at www.breakfastaway.pt, providing the requested information, namely Address, Telephone Contact, E-mail.

2.1) Login (by providing a combination of e-mail and password chosen by the User at registration).

2.2) Complete the information and choose the options that are made available to you during the check-out process (delivery and billing address; shipping method; payment method).

3. The submission of the order by the User is equivalent to full and complete acceptance of the prices and description of the products available for sale, as well as the general conditions of sale, which will be the only ones applicable to the contract thus concluded;

4. Breakfast Away will honor orders received online only to the extent of available stocks. If the product is not available, Breakfast Away undertakes to inform the User as soon as possible;

5. If the payment is not received or validated by Breakfast Away – in the case of payment at the end of the period, within the said period – the order cannot be validated. Any amount received after this date will be refunded or used for a new order.

DELIVERY

Orders will be delivered by Breakfast Away’s own distributor or by a third party, and there may or may not be additional costs depending on the area chosen by the user.

Breakfast Away undertakes to deliver the products ordered at the time chosen by the user according to the availability of the site, always striving to meet these deadlines, but does not assume any responsibility for the inconvenience or damage inherent in the failure to comply with them.

PAYMENT

All prices PVP incl. VAT

In the event of an increase in the price of a product, deliveries will be invoiced at the price that was considered in the ordering process.

Breakfast Away offers the User several payment methods, only part of which may be available: Credit Card (Visa and MasterCard), MultiBanco Reference, MB Way and PayPal.

CANCELLATION AND RETURNS

The cancellation or return process is handled on a case-by-case basis by Breakfast Away. The request must be sent in writing to geral@breakfastaway.pt by 12 noon the day before delivery. Instructions for canceling or returning the goods will be sent by Breakfast Away, by the same means of communication.

Whenever possible, the return should be made by the same payment method, but if this is not possible, the user must provide proof of payment and account or card ownership, so that the return can be made by Bank Transfer.

Breakfastaway undertakes to reimburse the User within a maximum period of 30 days.

Breakfastaway is an online breakfast home delivery platform.

Braga, Portimão, Albufeira and Lagos:
